Trio Arrested for Burglary, Evading Arrest

On March 6, Deputy Ray Yockey with the Henderson County Sheriff’s Office received a call from HCSO Dispatch regarding a theft in progress at a residence on Highway 175 East just outside the city of Athens. The witness was able to provide vehicle and suspect descriptions of the suspects that fled the area. Deputy Josh Rickman, who was leaving an unrelated incident in the Lake Athens area, began checking the area near Highway 175 East, for the suspect vehicle involved in the theft.

While Deputy Rickman was checking area, he observed a truck that matched the description that the witness gave. Deputy Rickman also observed the suspect descriptions also matched the occupants of the truck. Seeing this, Deputy Rickman attempted to stop the vehicle for questioning. At this time, the vehicle refused to pull over and a vehicle pursuit ensued. The pursuit came to an end when the suspects lost control of their vehicle and crashed on CR 4800. All suspects were then detained, until positively identified by the witness. At that time, all subjects were placed under arrest and transported to the Henderson County Jail. All subjects were charged with Burglary of a Habitation, a second degree felony, and the driver of the vehicle Peyton Boswell was also charged with Evading Arrest in a motor vehicle, a state jail felony.

The suspects included Peyton Boswell, 19, of Athens; Tristian Boswell, 17, of Athens; and Dominique Tuggle, 21, of Coffee City.

In the state of Texas, a state jail felony is punishable by 180 days to 2 years confinement, and a fine not to exceed 10,000. A second degree felony is punishable by 2 to 20 years confinement, and a fine not to exceed 10,000.
