Methamphetamine, warrant arrests
On Oct. 19, at approximately 9:20 p.m., Henderson County Sheriff’s Office Patrol Sergeant Matthew Jistel performed a traffic stop on a vehicle near the 14500 block of FM 2329 in Eustace. During the traffic stop, Sergeant Jistel located a small plastic baggie containing a crystal like substance believed to be methamphetamines. James Gregg a white male from the Eustace area was arrested and transported to the Henderson County Jail. Lauren Abbott a white female from the Eustace area was also arrested on two outstanding warrants out of the Log Cabin Police Department. Upon arrival at the Jail, Abbott was found to be in possession of two small baggies containing a white substance believed to be methamphetamines. Gregg was booked into the Henderson County Jail for Possession of a Controlled Substance Penalty Group 1 more than 1 gram, but less than 4 grams. Abbott was booked into the Henderson County Jail for her two outstanding warrants and Possession of a Controlled Substance Penalty Group 1 less than 1 gram. Possession of a Controlled Substance PG 1 over one gram less than four grams is a Third Degree Felony and is punishable from 2 to 10 years in prison and a $10,000 fine. Possession of a Controlled Substance PG 1 less than one gram is a State Jail Felony and is punishable up to 2 years in prison and a $10,000 fine. Gregg and Abbott remain in the Henderson County Jail awaiting arraignment by a Judge.
Two arrested on drug charges
On October 19, 2015 Henderson County Sheriff’s Deputy Kenny Collard observed an occupant of the vehicle in front of him throw an object out of the passenger side window and into the grass. Deputy Collard believed the object to be a glass pipe commonly used to smoke methamphetamine. Deputy Collard initiated a traffic stop on the vehicle and made contact with the occupants. After questioning the suspects the passenger, Joshua Dale Lindsey, admitted to throwing a glass pipe out of the window when they noticed that the Deputy was behind them.
The pipe was located by assisting Henderson County Sheriff’s Office Deputy John Daniels. The pipe contained a substance believed to be methamphetamine.
The driver, Amanda Kay Lindsey, was charged with Possession of a Controlled Substance Penalty Group 1 less than one gram, No Driver’s License, and Fail to Maintain Financial Responsibility.
Joshua Dale Lindsey was charged with Tamping/Fabricating Physical Evidence and Possession of a Controlled Substance Penalty Group 1 less than one gram.
Tamping/Fabricating Physical Evidence is a third degree felony – An individual adjudged guilty of a felony of the third degree shall be punished by imprisonment in the institutional division for any term of not more than 10 years or less than 2 years. In addition to imprisonment, an individual adjudged guilty of a felony of the third degree may be punished by a fine not to exceed $10,000.
Possession of a Controlled Substance Penalty Group 1 less than one gram is a State Jail Felony. An individual adjudged guilty of a state jail felony shall be punished by confinement in a state jail for any term of not more than two years or less than 180 days.
